Online Trademark Search in India

Before filing a trademark application, a Trademark search must find potential with existing trademark applications and even registered trademarks. A trademark search can be done by providing the word mark and the class under which the investigation is conducted.

A trademark application is made under 45 different classes as per the NICE classification for Trademark. Each of the trademark classes represents a different set of goods and services. To find the trademark class for particular goods or services, an individual should use trademark class finder tools.

TAXAJ has made trademark search easy through the online tool. But again, this tool might not contain the most recent trademark application information. Hence, it is always better to conduct another online trademark search online on the Government website as a second opinion.

Why is it necessary to conduct a Trademark search?

Conducting a Trademark search online will provide the name information of a registered brand name/Trademark, which can be similar (phonetically) to your Trademark. A list of prohibited marks is provided so that an individual can check whether the brand name or the Trademark falls under such banned characters. Under the Vienna code classification, if the brand name has a logo, then a trademark search gives you the information and details of similar brand names.

It is essential to conduct a Trademark search to register the applicants' trademark or brand mark logo under the Trademark Act. In case a similar Trademark exists in the registry of Trademarks, the name can be altered, or an individual can select a new name. If any similar trademark exists, then the newly applied Trademark should be altered, or a new name can be selected. If the brand name is unique, then one can go ahead to register the brand the name. It is always advisable to conduct a trademark search before filing a trademark application to register the Trademark.

Trademark Database

In India, the Comptroller General of Patent Designs and Trademark controls the Trademark registrations and the registered trademarks. Both professionals and non-professionals can use the online trademark search database and non-professionals to do a trademark search.

The Trademark database contains all the trademark applications submitted to the Trademark registrar in India, including all registered, applied, objected, and expired trademarks. A trademark search will give the user an insight into the valuable information relating to the trademark search query.

Trademark Search Procedure

To conduct a trademark search in India, visit the trademark search database using a web browser.

  • Select Wordmark as the Search type at the top of the page

  • Enter the wordmark you would like to search on the trademark database. The trademark database can be compared against the search query with three conditions- 'start with,' 'contains' and 'match with.'

Start with display all the entries in the trademark search database that start with the value provided for search.
Contains all display all the entries in the trademark search database that contains all the value provided for search
Match will display all the entries in the trademark search database that matches the value provided for the search.

  • The class of the Trademark that is applicable should be entered. Trademarks are divided into 45 classes wherein each class represents a distinct group of goods and services. A registered trademark or trademark application will only be pertinent to the class under which it is applied for
  • With the final step, you can click on search to begin the Trademark search.

Trademark Search Results

Here is an example with the word Ford.

The trademark search above displays the result of all the trademarks that start with the word “Ford” registered under class 12.

The next " show details " option would display all the information pertaining to the trademark application number, application date, owner information, trademark validity date, the date it is used from, and also a description.

A simple search will bring up a number of matches, and understanding the trademark search status is essential for interpreting the implications.

If "no matches found" is displayed, then there are no registered or applied trademarks that match the query. For a trademark to be registered, it must not be similar to any existing trademarks.
