Registration Process

Trademark Registration in India — Step by Step

1

Search & Class Selection

Conduct prior art search on IP India portal to check for similar marks in the same class. Select correct class(es) based on your goods/services. Wrong class = no protection.

⏱ 1–2 days
2

Application Filing

File trademark application online on IP India (ipindia.gov.in) with brand name/logo, class selection, specification of goods/services, applicant details, and government fee payment.

⏱ 1 day | TM Number issued same day
3

Examination & Objection

Examiner reviews application in 30-90 days. If objection raised (similarity to existing marks, descriptiveness): file reply to examination report within 30 days. TAXAJ handles objections.

⏱ 3–12 months
4

Publication & Registration

Mark published in Trade Marks Journal for 4 months (opposition window). If no opposition: Registration Certificate issued. Valid for 10 years from application date, renewable indefinitely.

⏱ 12–24 months total
™️ Pro tip: File your trademark application immediately after registering your brand name — even before you start using it. You can claim ™️ (unregistered) right away, and ® (registered) once registration is complete. Filing early protects your priority date and prevents competitors from registering similar marks.
Key IPR Concepts

6 Things Every Brand Owner Must Know About Trademark Registration

™️ Why Trademark Class Matters

A trademark registration only protects your brand within the class(es) you register in. If you register "XYZ" in Class 25 (clothing) only, a competitor can register "XYZ" in Class 35 (retail services) without infringing. Always register in all classes that cover your current business AND likely future expansion. Most businesses need 2–4 classes. E-commerce companies typically need Class 35 (retail/online selling) + the product's class.

🔍 Trademark Search — Before You File

Before filing, search the IP India database (ipindia.gov.in) for similar marks in the same class. Search for: (1) Identical marks, (2) Phonetically similar marks (Colgate vs Kolgate), (3) Similar logo/device marks. A trademark search does NOT guarantee registration — the examiner has discretion. TAXAJ conducts comprehensive trademark searches including phonetic similarity analysis, reducing the risk of objection after filing.

📋 Multi-Class Filing — File Once, Protect More

As of 2023, India allows a single multi-class trademark application covering multiple classes. Previously, separate applications were needed for each class. Multi-class filing benefits: (1) Single application tracking number, (2) Same filing date (priority) for all classes, (3) Administratively simpler. Government fee is still charged per class. Most brands benefit from filing in at least 2 classes — e.g., a food company: Class 30 (food products) + Class 43 (restaurants/food services).

⏰ Trademark Objection — Don't Miss 30 Days

If the Examiner raises an objection, you have 30 days to file a reply. Missing this deadline results in abandonment of the application — you lose the filing date and must start over. Common objections: (1) Similarity to existing marks (overcome by arguing non-similarity or coexistence), (2) Descriptiveness (overcome by proving acquired distinctiveness or disclaiming the descriptive part), (3) Non-distinctiveness. TAXAJ has handled hundreds of trademark objection replies with high success rates.

🌍 International Trademark — Madrid Protocol

India is a member of the Madrid Protocol — a treaty allowing trademark registration in 128 countries through a single international application via WIPO. How it works: (1) File a basic Indian trademark application first, (2) Apply through WIPO after Indian filing, designating target countries, (3) WIPO notifies each country's registry. Cost: WIPO fee (CHF 653 + per class fee per country) + Indian attorney fee. Simpler and cheaper than filing separately in each country. TAXAJ handles Madrid Protocol filings for brands expanding internationally.

⚖️ Trademark Infringement — Your Rights

Once registered, you have the right to sue infringers in India. Remedies: (1) Civil suit: Injunction (stop the infringer immediately) + damages/accounts of profits, (2) Criminal complaint: Under Section 103 of the Trade Marks Act — imprisonment up to 3 years + fine up to ₹2 lakh, (3) Customs seizure: Register mark with Customs to stop import of infringing goods. Unregistered trademark owners have passing-off rights (harder to enforce). Registration is the strongest form of brand protection. TAXAJ handles trademark infringement notices and litigation.

FAQ

Trademark Registration India — Frequently Asked Questions

Technology and software companies typically need multiple classes: Class 9 — Software, apps, downloadable content, electronic devices, SaaS products, cybersecurity tools. Class 35 — IT business services, online marketplace, data management, advertising services. Class 42 — Software development, cloud computing, SaaS (as a service), IT consultancy, cybersecurity services, AI/ML services, website design. Class 38 — Telecommunications, internet connectivity, streaming services, VoIP. Most SaaS companies file in Class 9 (product) + Class 42 (service). An e-commerce platform additionally needs Class 35. TAXAJ provides a detailed class strategy for tech companies with potential for expansion into adjacent services.
Yes — you can use the ™️ (TM) symbol immediately after filing your trademark application, or even before filing (to signal you are claiming trademark rights in the brand). The ™️ symbol does not require registration — it is a common law claim. The ® (Registered) symbol can ONLY be used after the Trademark Registry issues the Registration Certificate. Using ® before registration is a criminal offence under Section 107 of the Trade Marks Act 1999 — punishable with imprisonment up to 3 years and/or fine. TAXAJ issues a formal confirmation letter on the day of filing so you can legitimately use ™️ immediately.
The trademark registration process in India typically takes 18–36 months end to end, though the application is issued a TM number on the day of filing (which acts as proof of application). The timeline: Filing → Examination (6–12 months) → Reply to Objection if any (within 30 days of objection) → Publication in Journal (4 months opposition window) → Registration Certificate (2–4 months after journal). If objections and oppositions arise, the timeline extends. Note: Even during the registration process, your brand is protected from the filing date. The TM number on the application is important legal evidence of your priority date.
A word mark protects the brand name in any font, colour, or style. Example: "APPLE" (word mark) covers any use of the word Apple for computers, regardless of font. A device mark (logo mark) protects the specific logo design, colours, and layout. Example: Apple's bitten apple logo (device mark). Best practice: File BOTH — the word mark protects the name across all visual representations, and the device mark protects the specific logo design. If you file only a device mark with the name embedded in it, competitors may use your brand name in a different logo and argue they are not infringing. TAXAJ recommends filing word + device marks as a combined strategy for maximum protection.
No — trademark rights are territorial. An Indian trademark registration gives protection only in India. For international protection: (1) Madrid Protocol: File in 128+ countries through a single application via WIPO (most cost-effective for 3+ countries). (2) Direct national filings: File separately in each country (USA, EU, UAE, etc.) through local attorneys. (3) EU Trademark (EUTM): One application covering all 27 EU member states. (4) Community Design: For design marks across EU. Priority note: If you file in India and within 6 months file internationally, the international application can claim the Indian priority date — protecting you from competitors who filed in those countries after your Indian filing. TAXAJ handles international filings under Madrid Protocol and direct national filings.
