Circle Rate — 6 Things Every Property Buyer Must Understand

📐 How Circle Rate Value is Calculated

Circle Rate Value = Area (sqm or sqft) × Circle Rate (₹/sqm or sqft). For flats in Delhi, additional multipliers apply for age (0.5 to 1.0) and construction type (pucca=1, semi-pucca=0.75, kaccha=0.5). For plots, only the land rate applies. The formula varies slightly by state — Maharashtra uses built-up area with parking additions.

⚖️ Higher of Two Values Rule

Stamp duty is always charged on the higher of circle rate value or actual transaction price. If you buy at ₹80L but circle rate value is ₹90L — stamp duty is on ₹90L. You cannot register below the circle rate. The Sub-Registrar will demand proof and will use the higher value automatically.

💰 Section 50C — Seller's Tax Liability

If you sell property below circle rate, Section 50C of the Income Tax Act deems the circle rate value as your sale consideration for capital gains tax — not your actual selling price. If your actual price is up to 110% of circle rate, no issue. If actual is more than 10% below circle rate, the difference is treated as capital gains income and taxed accordingly.

⚠️ Section 56(2)(x) — Buyer's Tax Risk

If you buy property at a price more than 10% below the circle rate, Section 56(2)(x) treats the difference as "income from other sources" and taxes it in your hands as income. Example: circle rate value ₹1Cr, you buy at ₹80L — ₹20L treated as your taxable income. Always ensure transaction price is within 10% of circle rate to avoid this.

🔄 When Circle Rate > Market Value

In declining markets or for old/dilapidated properties, circle rates can exceed actual market value. In such cases, you still pay stamp duty on the higher circle rate value. Karnataka allows site-specific valuation appeals for disputed areas. Maharashtra allows representations. Delhi buyers can approach Revenue Department with documented evidence of lower market values.

📅 Circle Rate Revision Frequency

Maharashtra updates Ready Reckoner Rates annually (April 1 each year). Karnataka last revised in Oct 2023 and Feb 2026. Delhi last major revision was 2014 (residential) — a revision has been pending for years. Check the state portal before each transaction — rates can change without buyer notification.

⚠️ Important: Delhi 20% Rebate Has ENDED (Effective 1 January 2026)

The Delhi government's 20% reduction on circle rates ended on December 31, 2025. From January 1, 2026, all Delhi property transactions use the full circle rate. A property that had an effective circle rate value of ₹80L now registers at ₹1 Crore (the full rate). Buyers who budgeted based on the rebated rate need to revise their stamp duty calculations. A fresh comprehensive circle rate revision (the first since 2014) is expected — monitor revenue.delhi.gov.in for notifications.

Circle Rate / Ready Reckoner Rate — Frequently Asked Questions

Circle rate (also called Ready Reckoner Rate in Maharashtra, Guidance Value in Karnataka, Jantri Rate in Gujarat, DLC Rate in Rajasthan, Collector Rate in Haryana) is the minimum price set by the state government at which a property can be registered. It's a floor price for stamp duty purposes. Market rate is what buyers and sellers actually agree upon based on demand, location, and amenities — and is typically higher than circle rate in most areas. No property can be registered below the circle rate. Stamp duty is charged on whichever is higher — circle rate value or actual transaction price.
Two things happen: (1) Stamp duty is still charged on the circle rate value, not your lower transaction price — you can't save stamp duty by undervaluing. (2) Under Section 56(2)(x) of the Income Tax Act, the difference between the circle rate value and your actual purchase price (if more than 10%) is treated as your income from other sources and is taxed. For the seller, Section 50C deems capital gains on the circle rate value, not actual lower sale price. Both buyer and seller face tax consequences. Exception: up to 10% variation between actual price and circle rate is allowed by the IT Act without triggering these provisions.
Revision frequency varies by state: Maharashtra revises Ready Reckoner Rates every year on April 1 (April 2025: average 4.39% increase). Karnataka revised in October 2023 (25–30% hike) and again in February 2026 (6–15%). Delhi's residential rates were last comprehensively revised in 2014 (though a major revision is expected). UP and Haryana revise rates periodically — check state portals annually before transactions. Note that even when rates are frozen, new construction, infrastructure upgrades, or policy changes can trigger selective revisions.
Individual buyers cannot formally appeal against circle rates — rates are set by the government and apply to all transactions in that locality. However: (1) For disputed/dilapidated properties where circle rate clearly exceeds market value, you can approach the Collector of Stamps with valuation evidence for a site-specific assessment (Section 31A of Stamp Act). (2) Builders' associations and RWAs can make representations to the state government during rate revision consultations. (3) Some states like Karnataka have a formal appeal process. (4) If you've already paid excess stamp duty due to an error, most states allow refund claims (usually within 6 months). TAXAJ can guide you through the appeal or refund process.
Delhi uses an age-based depreciation factor for built-up properties (flats and houses). The multipliers are: buildings constructed after 2000: factor 1.0 (no depreciation); 1990–2000: factor 0.9; 1980–1990: factor 0.8; 1970–1980: factor 0.7; 1960–1970: factor 0.6; before 1960: factor 0.5. For example, a 1985-built DDA flat of 100 sqm would use the applicable construction rate × 0.8 age factor. This is applied to the construction cost component, not the land rate component. Older buildings thus attract lower circle rate valuation, which can reduce stamp duty for buyers of old properties. Check the exact formula at revenue.delhi.gov.in.
