Stamp Duty — Everything You Need to Know
📊 Circle Rate vs Market Value
Stamp duty is paid on the higher of transaction value or circle rate (called ready reckoner in Maharashtra, guidance value in Karnataka, collector rate elsewhere). If you buy at ₹45L but circle rate is ₹50L — you pay stamp duty on ₹50L. Always check the circle rate for your locality before budgeting.
👩 Women Buyer Concession
15+ states offer 1–2% lower stamp duty for female buyers. Delhi: saves 2% (4% vs 6%). Punjab: saves 2% (5% vs 7%). Maharashtra, UP, Karnataka, Haryana: save 1%. On a ₹50L property, a 2% saving = ₹1 lakh. Joint ownership with woman as first owner also qualifies in most states.
💰 Section 80C Deduction
Stamp duty and registration charges paid for a residential property are deductible under Section 80C up to ₹1.5 lakh in the year of payment. On ₹1.5L deduction at 30% tax bracket → saves ₹46,800 in income tax. Only under old tax regime. Commercial properties not eligible.
🎁 Gift Deed Rates
Gift deeds to close relatives (parents, spouse, children, siblings) attract lower stamp duty in most states — often 0.5%–2% vs 5%–7% for sale. Karnataka: 0.5% for family gifts. Maharashtra: ₹200 flat for blood relatives. Delhi: 4%/6% same as sale. Always cheaper than sale deed for family transfers.
⚠️ Late Payment Penalty
Stamp duty must be paid before or at the time of property registration. Late payment attracts 2% monthly penalty in most states (Maharashtra). Tamil Nadu imposes 25% penalty for delays exceeding 6 months. Some states can cancel registration. Budget and pay on time — never add stamp duty to your home loan.
