TAXAJ Website Policies

These policies govern your use of the TAXAJ website, blogs, tools, portals and services provided by TAXAJ LLP ("TAXAJ", "we", "us" or "our"). Please read them carefully โ€” by accessing our website or engaging our services, you agree to be bound by them.

Our commitment: TAXAJ has never sold your personal information for advertising, and we never will. We collect only what we need to serve you, protect it with strict controls, and give you meaningful choices over your data.

Introduction & Acceptance

This document is published by TAXAJ LLP, a Limited Liability Partnership incorporated in India with its registered office at 1/3, UGF, Sulahkul Vihar, Sector 14 Dwarka, New Delhi 110078, and branches in Delhi, Bihar, Bengaluru and Goa. It consolidates the Privacy Policy, Terms of Use, Refund & Cancellation Policy, Disclaimers and other policies (together, the "Policies") that apply to www.taxaj.com, its subdomains, blogs, knowledge base, calculators, tools, customer portals, mobile applications and all services offered through them (together, the "Services").

By accessing our website or using any of the Services, you confirm that you have read, understood and agree to these Policies. You may not use the Services if you do not accept them. You must be of legal age to form a binding contract under the Indian Contract Act, 1872. If you are using the Services on behalf of an entity, you represent that you are authorised to bind that entity.

TAXAJ is a financial-consulting firm providing tax, accounting, secretarial, legal support, FEMA, IPR, foreign-subsidiary and allied advisory and compliance services. TAXAJ is not a firm of Chartered Accountants; where a service requires attestation or certification by a Chartered Accountant, Company Secretary, Cost Accountant or Advocate, it is rendered by an appropriately qualified professional empanelled with or engaged by TAXAJ.

Privacy Policy

This Privacy Policy explains what information we collect, how we use and share it, how long we keep it, and the choices and rights you have. It is designed to comply with the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000 and the rules made thereunder, and, where applicable, the EU/UK GDPR.

Part I โ€” Information we collect and control

We collect information you actively provide โ€” your name, contact details and KYC information when you enquire, register, raise a query or purchase a service. We do not store full credit/debit card numbers; card payments are processed by PCI-DSS-compliant payment gateways. When you visit the website, we automatically log limited technical data (how you reached us, pages viewed, features and settings used, device/browser and IP information) to operate, secure and improve the Services.

Sometimes we receive information indirectly โ€” for example, from referral programs, reselling partners, or platforms such as LinkedIn or Google where you have permitted them to share your contact details, or from your public interactions with us on social media. We process such information to respond to your request.

Legal basis & purpose

We process personal data on one or more lawful bases: your consent; the necessity to perform a service you requested or a contract with you; compliance with a legal obligation; or our legitimate business interests (such as securing and improving the Services). We use your information to deliver and maintain the Services, communicate about your engagements and support requests, send policy or service updates, and โ€” where permitted โ€” tell you about services that may interest you.

Sharing & disclosure

We limit access to your personal information to employees, professionals and contractors who have a legitimate need to use it, and to service providers (such as payment gateways, cloud, communication and domain providers and reselling partners) who are bound by confidentiality and appropriate security obligations and may use it only for the stated purpose. We may disclose information to authorities where necessary to comply with a legal obligation, respond to lawful requests, prevent fraud, enforce our agreements, or protect the rights, property or safety of TAXAJ, our users or the public.

Your rights & choices

Subject to applicable law, you may request access to, correction or erasure of your personal data, withdraw consent, restrict or object to certain processing, and request data portability. You may nominate another individual to exercise your rights in the event of death or incapacity (as provided under the DPDP Act). You can disable cookies in your browser (some features may then not work). To exercise any right, contact our Grievance Officer (section 19). We honour these rights for all users regardless of where you live.

Retention

We retain personal information for as long as needed for the purposes described here or as required by law. When there is no longer a legitimate need, we delete, anonymise or isolate it.

Part II โ€” Information we process on your behalf

If you use our Services to process data about your own customers or employees ("client data"), you entrust that data to us. You own your client data. We protect it, restrict access to it, and process it only on your instructions. After you terminate your account, we delete client data from our active systems within a reasonable period and from backups thereafter, save where retention is required by law. If you believe your data was entrusted to us by a third party (e.g. your employer), please contact that third party first; we will assist them with your request.

Children & minors

Our Services are intended for users who can form a binding contract. We do not knowingly collect personal data of children except where processed on behalf of a client with verifiable parental/guardian consent as required by the DPDP Act. If you believe a minor has provided us data, alert us and we will delete it.

Cookie Policy

We use cookies and similar technologies to keep the website secure, remember your preferences, understand usage and improve our Services. Cookies are small files stored on your device. We use strictly necessary cookies (required for the site to function), performance/analytics cookies (to understand and improve usage), and preference cookies (to remember your settings).

You can control or delete cookies through your browser settings and opt out of non-essential cookies. If you disable certain cookies, some features may not work as intended. Third-party tools we use (e.g. analytics or tag managers) may set their own cookies governed by their own policies.

Terms of Use / Terms of Service

These Terms are an agreement between you (or the entity you represent) and TAXAJ LLP governing your use of the TAXAJ website and Services. You accept the Terms by using the Services or creating an account on any TAXAJ website. You may not use the Services if you do not accept the Terms, are not of legal age to contract, or are barred from doing so under applicable law.

Provision & changes to the Services

We continually improve our Services and may change their form and nature, add or remove features, or suspend or discontinue the Services (in whole or part) at our discretion, with or without notice. Fixed limits on usage or storage may be introduced at any time. You may stop using the Services at any time. If we disable access to your account, you may be prevented from accessing your account details or content.

Your use of the Services

You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws, regulations and accepted practices, including laws on the export of data or software to and from India. You agree not to: access the Services other than through the interface we provide; use automated means (scripts, crawlers) except as permitted; interfere with or disrupt the Services, servers or networks; or reproduce, duplicate, copy, sell, resell or exploit the Services without our written permission. You are solely responsible for any breach of these Terms and its consequences.

Where a Service requires it (e.g. income-tax filing), you authorise TAXAJ to act as your authorised representative on the relevant government portal to submit returns and retrieve documents such as ITR, ITR-V, refund status and Form 26AS/AIS. If you file or transact on behalf of another person, you confirm you do so with their knowledge and consent; TAXAJ is not responsible for actions taken without such consent.

Account & password security

You are responsible for maintaining the confidentiality of your passwords and for all activity under your account. Notify us immediately of any unauthorised use. TAXAJ is not liable for loss arising from your failure to keep credentials secure.

Scope of Services & Professional Disclaimer

Each engagement is limited to the specific service, deliverable and scope agreed with you at the time of purchase or in a written proposal/quotation. Anything outside that agreed scope โ€” including additional forms, filings, government fees, litigation, representation, or subsequent-year compliance โ€” is a separate engagement and may be charged separately.

No guaranteed outcome. Statutory approvals, registrations, refunds, allotments and timelines depend on government authorities (MCA/ROC, Income Tax, GST, RBI, IPR offices and others) and third parties beyond our control. Indicative timelines are estimates only. TAXAJ does not guarantee any particular approval, result, timeline or refund, and is not responsible for delays, rejections, notices, penalties or changes in law by such authorities.

Correctness of filings. TAXAJ takes great care and uses internal and third-party reviews to ensure the correctness of returns and documents; however, we provide no guarantee or warranty of correctness. You are required to review every return and document for accuracy before submission and confirm the facts and figures you provide. You will not hold TAXAJ responsible for issues arising from incorrect information supplied by you or from incorrect filing you have approved.

Client Responsibilities & Accurate Information

To deliver the Services, we rely on the information, documents and instructions you provide. You agree that all information you give TAXAJ will be true, accurate, complete and up to date, and that you will provide required documents and approvals promptly. You are responsible for the authenticity and legality of documents you submit. TAXAJ is entitled to rely on your information without independent verification and is not liable for consequences arising from information that is false, incomplete, delayed or misleading.

Delays caused by non-submission of documents, non-response, non-payment of government fees, or third-party/authority processing times may extend timelines and are not attributable to TAXAJ.

Fees, Payments, Refund & Cancellation Policy

Fees. Our professional fees are quoted per engagement and, unless expressly stated otherwise, are exclusive of GST and of all government/statutory fees, challans, stamp duty, publication and third-party charges, which are payable at actuals. Fees once quoted may be revised for changes in scope, capital, entity type, turnover or law. We accept payment via bank transfer, UPI, Google Pay, Paytm, debit/credit card and other listed modes.

Refund & cancellation

  • Government fees, stamp duty and third-party charges are non-refundable once paid to the concerned authority/vendor.
  • Once any computation, drafting, filing or document preparation has commenced or been delivered at our end, professional fees for that work are non-refundable.
  • For assisted plans, you may cancel and request a refund of the professional fee before the assigned expert has commenced work on your case. Approved refunds are processed within 5โ€“7 working days to the original payment method.
  • Refund requests must be raised in writing to [email protected] with your order details.

Acceptable Use Policy

When using our website and Services, you must not: (a) violate any law or third-party right; (b) upload or transmit unlawful, defamatory, obscene, infringing or harmful content; (c) attempt to gain unauthorised access to any system, account or data; (d) introduce malware, viruses or harmful code; (e) scrape, harvest or reverse-engineer the Services except as permitted by law; (f) impersonate any person or misrepresent your affiliation; (g) use the Services to send spam or unsolicited communications; or (h) interfere with the integrity or performance of the Services. We may investigate and take appropriate action, including suspension or termination and reporting to authorities, for any violation.

Intellectual Property & Copyright

All content on the TAXAJ website โ€” including text, articles, guides, calculators, tools, graphics, logos, the "TAXAJ" name and marks, layout, code and design โ€” is owned by or licensed to TAXAJ LLP and is protected by Indian and international intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the website for your own lawful, non-commercial use.

You may not copy, reproduce, republish, distribute, sell, licence, frame, scrape or create derivative works from any part of our content or Services without our prior written permission. Unauthorised use may result in civil and criminal action. If you believe any content infringes your intellectual-property rights, please contact us at [email protected] with details and we will act on valid notices.

Confidentiality

We treat the non-public information you share with us in the course of an engagement as confidential and use it only to provide the Services. We do not disclose it to third parties except: to professionals, sub-processors and service providers bound by confidentiality on a need-to-know basis; where you consent; or where disclosure is required by law, regulation, or a competent authority or court. Our professionals are bound by applicable professional and statutory confidentiality obligations. This clause survives the completion or termination of your engagement.

Data Security

We implement reasonable technical, administrative and physical safeguards โ€” including access controls, encryption in transit, secure hosting and staff confidentiality obligations โ€” designed to protect personal and client data against unauthorised access, alteration, disclosure or destruction, consistent with the IT Act, 2000 and the DPDP Act, 2023.

However, no method of transmission or storage over the internet is completely secure. While we strive to protect your information, we cannot guarantee absolute security, and you share information at your own risk. In the event of a personal-data breach that is likely to affect you, we will notify you and the Data Protection Board / relevant authority as required by law.

KYC & Anti-Money-Laundering (AML)

As a professional services firm, we are required to verify the identity of our clients and, for certain engagements, the source and nature of funds and beneficial ownership. You agree to provide accurate KYC documents (such as PAN, Aadhaar, passport, incorporation documents and address proofs) on request. We may decline or discontinue an engagement, and are required to report as necessary, where we have reasonable grounds to suspect money laundering, terror financing, fraud or other illegal activity, in line with the Prevention of Money Laundering Act, 2002 and applicable guidelines. We will not knowingly assist any transaction that is unlawful.

No Investment / Financial-Product Advice

Investment and financial-product decisions carry risk. You should obtain independent advice from a suitably licensed adviser and read all offer documents before investing. TAXAJ is not responsible for any investment decision you make or its outcome.

Third-Party Links, Tools & Government Portals

Our website may link to third-party websites, government portals (e.g. MCA, Income Tax, GST, RBI, IPR), payment gateways, social-media widgets and tools that are not operated by us and have their own terms and privacy policies. We provide these for convenience and do not endorse, control or accept responsibility for their content, availability, accuracy or practices. Always review the relevant third party's policy before sharing information or transacting with them. Your dealings with any third party are solely between you and that third party.

Communication Consent (Email ยท SMS ยท WhatsApp ยท Call)

By providing your contact details or enquiring with us, you consent to TAXAJ (and our authorised representatives) contacting you by phone, SMS, email, WhatsApp and other channels for service, transactional, verification, support and โ€” where permitted โ€” promotional purposes, even if your number is registered under DND/NCPR. This consent overrides such registration to the extent permitted by law and continues until you withdraw it. You may opt out of promotional communications at any time by writing to [email protected] or using the unsubscribe option; transactional and service communications may still be sent.

Testimonials, Reviews & Marketing

Testimonials, ratings, case outcomes and media features shown on our website reflect the experience of specific clients or third-party publications and are not a guarantee of similar results for you. Past performance or outcomes do not assure future outcomes. Where you provide a review, testimonial or feedback, you grant TAXAJ a non-exclusive, royalty-free right to use and display it (with attribution as provided) for marketing, unless you request removal in writing.

Disclaimer & Exclusion of Warranties

The services and all website content are provided "as is" and "as available", without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, TAXAJ, its partners, affiliates, employees and licensors do not represent or warrant that: (a) the Services will meet your requirements; (b) access will be uninterrupted, timely, secure or error-free; (c) information obtained through the Services will be accurate, complete, current or reliable; or (d) defects will be corrected. Any material downloaded or obtained through the Services is at your own discretion and risk, and you are responsible for any resulting damage or data loss. No advice or information obtained from TAXAJ creates any warranty not expressly stated here. TAXAJ disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Policies excludes or limits liability that cannot be lawfully excluded.

Limitation of Liability, Indemnity & Force Majeure

Limitation of liability

To the maximum extent permitted by law, TAXAJ, its partners, affiliates, employees and licensors shall not be liable to you for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profit, goodwill, business, revenue, data or other intangible loss, arising out of or relating to your use of (or inability to use) the Services, however caused and under any theory of liability, even if advised of the possibility of such loss.

Without limiting the above, TAXAJ is not liable for loss or damage arising from: changes to or cessation of the Services; deletion, corruption or failure to store content; your failure to provide accurate information; your failure to keep account credentials secure; or reliance on any advertising, third party or authority. In all cases, TAXAJ's total aggregate liability arising out of or relating to an engagement or the Services shall not exceed the professional fees actually paid by you to TAXAJ for the specific service giving rise to the claim.

Indemnity

You agree to indemnify and hold harmless TAXAJ, its partners, affiliates and personnel from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or related to: your breach of these Policies or applicable law; information or documents you provide that are false, incomplete or infringing; or your misuse of the Services.

Force majeure

TAXAJ is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, pandemics, government action or change in law, portal/authority downtime, internet or power failures, strikes, war or civil unrest.

Grievance Redressal & Escalation Matrix

We aim to resolve every concern promptly and fairly. Please raise issues in the following order:

  2. Level 2 โ€” Escalation: if unresolved within a reasonable time, write to [email protected].
  3. Level 3 โ€” Grievance Officer: for data-protection and unresolved grievances, contact our Grievance Officer.

Governing Law, Jurisdiction & Termination

These Policies and any dispute arising out of or in connection with them or the Services are governed by and construed in accordance with the laws of India. Subject to the arbitration provision below, the courts at New Delhi shall have exclusive jurisdiction.

Dispute resolution. The parties will first attempt to resolve any dispute amicably. Failing that, the dispute shall be referred to arbitration by a sole arbitrator appointed by TAXAJ under the Arbitration and Conciliation Act, 1996; the seat and venue of arbitration shall be New Delhi and the proceedings shall be in English.

Termination. We may suspend or terminate your account or access on reasonable belief that you have violated these Policies or applicable law, or on technical or business grounds. You may stop using the Services at any time. Where you terminate because TAXAJ has materially breached these Policies, you may be entitled to a pro-rated refund of prepaid fees for services not yet rendered. Provisions that by their nature should survive (including IP, confidentiality, disclaimers, limitation of liability, indemnity and governing law) will survive termination.

Changes to These Policies & Contact

We may update these Policies from time to time to reflect changes in law, technology or our Services. The "Last updated" date shows when they were last revised. Material changes will be notified on this page and, where appropriate, by other means. Your continued use of the Services after changes take effect constitutes acceptance of the updated Policies. If we ever decide to sell our business, we will inform you.
