Yes. Under the Payment of Gratuity Act, 1972, gratuity is mandatory for all establishments with 10 or more employees. An employee who completes 5 years of continuous service becomes eligible. Gratuity = (Last drawn salary × 15 × years of service) ÷ 26. The maximum tax-free gratuity limit is ₹20 lakh (after the 7th Pay Commission revision). It must be paid within 30 days of the employee becoming eligible.
Full and final settlement (FnF) involves calculating and paying: unpaid salary for days worked in the last month, leave encashment for balance earned leaves, gratuity (if eligible), any pending reimbursements, TDS deduction on all FnF components, and deduction of notice pay if the employee leaves without serving notice.
