Hotel Registration in Himachal Pradesh: Provisional to Permanent Under the HP Tourism Act (2026)

Every hotel, guest house, restaurant, travel agent and adventure operator in Himachal Pradesh must be registered under the HP Tourism Development and Registration Act, 2002 before it opens. Section 25 makes operating unregistered an offence, and since the 2024 amendment the fine is ₹1 lakh plus up to ₹2,000 a day. In practice a new hotel goes through two stages: a provisional approval of the project before construction, and the permanent registration certificate once the building is complete and inspected. The certificate is valid for two years and is then renewed. This guide covers both stages, the documents and NOCs, the fees, and how hotels differ from homestays.

Stage 1: provisional registration (approval of the project)

The Act does not use the words “provisional” and “permanent”. They come from the Tourism Department’s own application checklist, which treats a new hotel in two steps. The first, before construction, approves the project and is what banks and investors usually ask for. It needs:

  1. Title papers for the land: jamabandi and tatima, or the lease deed.
  2. A feasibility report from a registered consultant or architect.
  3. Approved building plans and a cost estimate.
  4. A no-objection certificate from Town and Country Planning or the municipal body, or a Patwari or Pradhan certificate in rural areas.
  5. An undertaking for ten years on employing Himachalis (70% of staff).
  6. A site inspection by the DTDO or SDM.
  7. Consent from the HP State Pollution Control Board.

For a buyer who is not an agriculturist of Himachal, the land itself first needs permission under section 118 of the HP Tenancy and Land Reforms Act. See our guide to section 118 permission.

Stage 2: permanent registration on completion

  1. Application in Form I with the affidavit required by section 29.
  2. Title papers and the approved building plans.
  3. Completion certificate from the municipal body, Town and Country Planning, the SADA or HPPWD.
  4. Fire NOC under the Fire Department’s revised conditions, which now apply to both new registrations and renewals.
  5. Consent to operate from the Pollution Control Board.
  6. FSSAI licence where food is served.
  7. Inspection of the rooms and facilities by the DTDO’s office. Double rooms must be at least 120 sq ft and single rooms 100 sq ft.
  8. Payment of the fee.

The department then issues the certificate and fixes the season and off-season room rates, which must be displayed. Hotels are also graded A to E by the state. That grading is separate from the Ministry of Tourism’s star classification, which does not replace state registration.

Fees

Tourism unit Registration fee (Rule 4, 2012 Rules)
Hotel, up to 10 rooms ₹1,000
Hotel, 11 to 30 rooms ₹2,500
Hotel, above 30 rooms ₹5,000
Restaurant or bar ₹1,000
Travel agent ₹1,000
Guide or photographer ₹500
Adventure, water-sports or aero-sports operator ₹2,000

Renewal costs half the registration fee. These are the fees in the 2012 Rules; confirm the current figure with the DTDO before paying, as the department revises its schedules from time to time. Paragliding and rafting have their own rules and fees under the Aero Sports and River Rafting Rules; see our paragliding and rafting operator guide.

Changes after registration

  • New rooms or alterations: a fresh registration is needed within 90 days of any addition or alteration.
  • Monthly statistics on guests are due to the department by the 10th of each month.
  • Transfer: a certificate cannot be transferred to a new owner or operator without permission; doing so attracts a ₹1 lakh fine or cancellation.
  • Refusal or cancellation: the department can refuse or cancel for building bye-law violations or sub-standard premises, but must give a hearing first. An appeal lies within 90 days.

Hotel or homestay?

Point Hotel or guest house Homestay
Rules Tourism Trade Rules, 2012 HP Home Stay Rules, 2025
Size No limit Up to 6 rooms and 12 beds
Who can apply Owner or lessee Owner only
Fee ₹1,000 to ₹5,000 by rooms ₹3,000 to ₹18,000 a year by tariff and location
Validity 2 years 1 or 3 years
Where to apply DTDO, through the Tourism eServices portal or office homestay.hp.gov.in

A property that outgrows six rooms, or is run from leased premises, has to register as a hotel or guest house. See our step-by-step homestay registration guide.

Tax points for a new hotel

  • GST: registration above ₹20 lakh turnover. Rooms up to ₹7,500 a night attract 5% without input tax credit; above that, 18% with credit. A restaurant in a hotel that has any room priced above ₹7,500 a night charges 18% with credit; otherwise restaurant service is 5% without credit. See GST for Manali hotels and homestays.
  • Luxury tax on hotels ended when Himachal’s GST Act, 2017 repealed the old luxury tax law.
  • Income tax: a hotel is business income. Building costs go to the block of assets, so keep the completion certificate and bills together for depreciation claims.

Common mistakes

  1. Starting bookings before the permanent certificate arrives.
  2. Adding a floor or rooms without re-registering within 90 days.
  3. A completion certificate that does not match the approved plan, which is a ground for refusal.
  4. Letting the fire NOC or Pollution Control Board consent lapse, which blocks the renewal.
  5. Taking over a running hotel without getting the certificate transferred.

Frequently asked questions

What is provisional registration of a hotel in Himachal?

It is the Tourism Department’s approval of a hotel project before construction, based on the title papers, plans, feasibility report, planning NOC and a site inspection. Permanent registration follows once the building is complete and inspected.

How long does the department take to decide?

Sixty days under section 25(2). If it does not decide in that time, the application is treated as accepted.
