TDS on AI-Based Freelance Platforms in India (Upwork, Fiverr & More)
India’s freelance economy is booming through platforms like Upwork, Fiverr, Freelancer, Refrens and Truelancer. With that growth comes tax compliance — and Tax Deducted at Source (TDS) is a key part of it. This guide explains when TDS applies to payments made through AI-based freelance platforms, which sections and rates apply, and the compliance you need to keep.
What is TDS?
TDS is a mechanism where tax is deducted at the point income is generated rather than later. For freelancers, TDS may be deducted by the platform, by an Indian client, or by a foreign platform that routes payments through an Indian entity.
When is TDS applicable?
Whether TDS applies depends on who is paying and where they are located.
| Scenario | TDS applicable? | Section (rate) |
|---|---|---|
| Indian company paying an Indian freelancer | Yes | 194J (10%) |
| Indian platform paying an Indian freelancer | Yes | 194J or 194C |
| Foreign platform paying an Indian freelancer | Not directly | Treated as foreign income |
| Indian client paying through a platform | Yes | 194J |
| Platform deducting its commission | Yes (on commission) | 194H (5%) |
The key sections
Section 194J — professional or technical services: 10% (20% if PAN is not provided).
Section 194C — contractual work: 1% (individual/HUF) or 2% (others).
Section 194H — commission retained by the platform: 5%.
Platform-specific position
Foreign platforms such as Fiverr and Upwork do not deduct Indian TDS — the freelancer must report the income and pay advance tax. Indian platforms such as Refrens may deduct 10% under 194J or 1–2% under 194C; the freelancer can claim that TDS credit while filing the ITR.
GST angle
Freelance income exceeding Rs. 20 lakh (Rs. 10 lakh in special-category states) triggers mandatory GST registration, with GST at 18% on domestic services. Exports of services can be zero-rated by filing an LUT.
Compliance to maintain
Keep your invoices, Form 16A TDS certificates, bank statements, payment receipts and client contracts. Non-compliance can attract interest and penalties under Section 270A, and a late-filing fee of Rs. 1,000 to Rs. 5,000 under Section 234F for a delayed ITR. Reconciling the TDS in your Form 26AS/AIS before filing ensures you claim full credit for tax already deducted.
