In MCD areas, the FSSAI registration or licence becomes a “deemed” health trade licence only once you pay MCD’s licence fee. In NDMC areas (Connaught Place, Khan Market and the rest of Lutyens’ Delhi), a notification of 23 February 2026 treats FSSAI registration as the health licence and GST registration as the general trade licence, and no separate licence is issued, though NDMC still collects the fee. The separate police eating house licence was withdrawn in June 2025. This guide sets out what a restaurant, café or cloud kitchen in Delhi needs in 2026, and what the deemed licence does not cover.

MCD and NDMC side by side

Point

MCD areas

NDMC areas

Law

Delhi Municipal Corporation Act, 1957, sections 417, 420 and 421

NDMC Act, 1994

What counts as the licence

FSSAI registration or licence, once the MCD fee is paid

FSSAI registration (health) and GST registration (general trade)

Separate certificate?

Deemed licence through MCD’s portal

No separate health licence is issued

Fee

At MCD’s existing rates, by category and seats

Still recovered at NDMC’s existing rates

Validity

Tied to the FSSAI registration or licence

Tied to FSSAI and GST registration

Inspection

Risk-based, after the licence; three weeks to fix violations

Under the NDMC Act

MCD: the deemed health trade licence

Who it covers: 67 categories of food business in five groups: eating establishments (restaurants, cafés, dhabas, canteens), storage and sale (bakeries, sweet and namkeen shops), hawking, manufacturing, and others.

FSSAI alone is not enough. The deemed licence takes effect when the MCD fee is deposited. Under the Master Plan, commercial use on mixed-use streets is generally limited to the ground floor, with conversion charges. The Delhi Development Authority approved a new Master Plan (renamed MPD-2047) in August 2026, but it awaits central approval.

Fire NOC: premises that can hold more than 50 people are treated as assembly buildings needing a Fire NOC. In MCD areas it takes effect when you pay MCD’s fee; in NDMC areas FSSAI and GST registration count as the licence and no separate one is issued.

Is FSSAI registration enough for a restaurant in an MCD area?

Not on its own. The MCD fee must be deposited for the deemed health trade licence to take effect.

Do Delhi restaurants still need a police eating house licence?

No. Police licensing for eating houses was withdrawn on 19 June 2025.

Does a cloud kitchen need a health trade licence in Delhi?

Yes, as a catering or kitchen unit, deemed from its FSSAI registration once the fee is paid in MCD areas. It must also be in a location the Master Plan allows.

TAXAJ handles FSSAI, health trade licence, GST and trademark work for restaurants and cloud kitchens across Delhi from our Dwarka office.
