For FY 2025-26 (AY 2026-27), Sections 44AD, 44ADA and 44AE continue to offer this simplified route with revised higher turnover limits. This guide explains who qualifies, the rates that apply, and the key compliance rules to keep in mind.

What is the presumptive taxation scheme?

Under the presumptive scheme, eligible taxpayers declare a prescribed percentage of their turnover or gross receipts as taxable income. They are then presumed to have earned that income, and are not required to maintain regular books of account or get them audited. The scheme is designed for small taxpayers who find full-fledged bookkeeping and audit compliance burdensome.

Three sections govern the scheme:

Section 44AD – for eligible small businesses.

Section 44ADA – for specified professionals.

Section 44AE – for those in the goods carriage (transport) business.

Section 44AD – presumptive scheme for businesses

Section 44AD applies to resident individuals, resident Hindu Undivided Families (HUFs) and resident partnership firms (excluding LLPs) carrying on an eligible business. Income is declared at a presumptive rate of turnover:

8% of turnover or gross receipts received in cash.

6% of turnover or gross receipts received through digital or banking channels.

The turnover limit is Rs 2 crore. This is raised to Rs 3 crore where cash receipts do not exceed 5% of the total turnover, encouraging digital transactions.

Certain businesses cannot use Section 44AD – for example, those already covered by Section 44AE (goods carriage), agency businesses, and persons earning income from commission or brokerage.

The 5-year lock-in rule under 44AD

A taxpayer who opts for Section 44AD must continue with the scheme for at least five consecutive assessment years. If you opt out before completing five years, you cannot claim the benefit of presumptive taxation for the next five assessment years. During that period, if your income exceeds the basic exemption limit, you must maintain books of account and get them audited. Plan carefully before switching in and out.

Section 44ADA – presumptive scheme for professionals

Section 44ADA is meant for resident professionals in specified fields. Eligible professions include:

Legal

Medical

Engineering or architectural

Accountancy

Technical consultancy

Interior decoration

Any other profession notified by the CBDT

Professionals declare 50% of gross receipts as income. The gross receipts limit is Rs 50 lakh, raised to Rs 75 lakh where cash receipts do not exceed 5% of total gross receipts. Unlike Section 44AD, there is no five-year lock-in requirement for professionals under 44ADA.

Section 44AE – presumptive scheme for goods carriage

Section 44AE applies to individuals, HUFs, firms and companies engaged in plying, hiring or leasing goods carriages, provided they own no more than 10 goods vehicles at any time during the year. Presumptive income is computed per vehicle, per month:

Type of vehicle

Presumptive income

Heavy goods vehicle

Rs 1,000 per ton of gross vehicle weight, per month (or part of a month)

Other goods vehicles

Rs 7,500 per vehicle, per month (or part of a month)

Income is calculated only for the months the vehicle was actually owned during the year.

Comparison at a glance (FY 2025-26 / AY 2026-27)

Section

For whom

Rate

Turnover / receipts limit

44AD

Small businesses (residents, HUFs, firms)

8% cash / 6% digital

Rs 2 crore, up to Rs 3 crore if cash ≤ 5%

44ADA

Specified professionals

50% of gross receipts

Rs 50 lakh, up to Rs 75 lakh if cash ≤ 5%

44AE

Goods carriage (up to 10 vehicles)

Per-vehicle slab

Maximum 10 vehicles

Key benefits of the scheme

No detailed books of account need to be maintained under Section 44AA for the covered income.

No tax audit under Section 44AB is required, provided you declare income at or above the presumptive rate.

Simpler return filing – eligible taxpayers can usually file the shorter ITR-4 (Sugam).

Reduced compliance cost and paperwork, freeing up time for running the business or practice.

Advance tax and other compliance

Taxpayers opting for the presumptive scheme are still liable to pay advance tax, but with a relaxation: the entire advance tax can be paid in a single installment by 15 March of the financial year, rather than in four quarterly installments. Missing this deadline can attract interest under Section 234C.

Keep in mind that if you declare income lower than the presumptive rate and your total income exceeds the basic exemption limit, you lose the audit exemption and must maintain books and get them audited. If unsure which route saves you more, our team can help you compare options while handling your income tax filing end to end.

Frequently asked questions

Can an LLP opt for Section 44AD?

No. Limited Liability Partnerships are specifically excluded from Section 44AD. Only resident individuals, HUFs and resident partnership firms (other than LLPs) carrying on an eligible business can opt in.

What is the turnover limit for 44AD in FY 2025-26?

The limit is Rs 2 crore, raised to Rs 3 crore where cash receipts do not exceed 5% of total turnover. Digital and banking receipts are treated as non-cash for this test.

Is a tax audit needed under the presumptive scheme?

Generally no, as long as you declare income at or above the prescribed presumptive rate. If you declare lower income and your total income crosses the basic exemption limit, a tax audit under Section 44AB becomes applicable.

Does the 5-year lock-in apply to professionals under 44ADA?

No. The mandatory five-year continuation rule applies only to Section 44AD for businesses. Professionals under Section 44ADA can choose the scheme on a year-to-year basis.

When is advance tax due under the presumptive scheme?

The full advance tax liability can be paid in one installment by 15 March of the relevant financial year, instead of four quarterly installments.

Choosing the right presumptive section can simplify compliance and lower your effective tax burden, but the eligibility conditions and lock-in rules need to be applied carefully.
