Employers that cross the coverage threshold must register on the ESIC portal and contribute monthly so that eligible employees receive medical, sickness, maternity, disablement and dependant benefits. This guide explains ESIC applicability, the wage limit, contribution rates, the registration process and ongoing compliance for 2026.

What is ESIC registration?

ESIC registration is the statutory enrolment of an eligible establishment and its employees under the ESI Act. On registration, the employer is allotted a 17-digit ESI code number, and each covered employee is issued an insurance number that links them and their family to the ESIC network of dispensaries and hospitals. Registration is mandatory once an establishment becomes coverable; it is not optional, and delayed or non-registration attracts interest and damages.

Applicability: who must register

Coverage depends on the number of persons employed and the nature of the establishment, read together with the state notification that applies to it. The commonly applied thresholds are as follows.

Factories and many notified establishments employing 10 or more persons must register.

Certain establishments and shops or commercial establishments in some states are covered only at 20 or more persons, because state governments have issued their own notifications under the Act.

Notified categories such as shops, hotels, restaurants, cinemas, road-motor transport undertakings, newspaper establishments and private educational and medical institutions are generally covered where they meet the applicable headcount.

Because the applicable threshold and the classes of covered establishments vary by state, the correct position should always be confirmed against the notification in force for the state where the unit operates. Once an establishment crosses the relevant threshold, the employer must complete ESI registration within 15 days.

Wage limit for coverage

ESI covers employees whose monthly gross wages do not exceed the prescribed ceiling. For 2026 the position is:

Rs 21,000 per month for employees generally.

Rs 25,000 per month for employees with disability.

An employee earning above the ceiling is outside coverage. Importantly, if a covered employee’s wages rise above Rs 21,000 mid-way through a contribution period, contributions must continue until the end of that period. The two contribution periods run from April to September and from October to March.

Contribution rates for 2026

The contribution rates have remained unchanged since July 2019 and continue to apply in 2026.

Employer contribution: 3.25% of the employee’s gross wages.

Employee contribution: 0.75% of the employee’s gross wages.

Total contribution: 4% of gross wages.

Employees earning an average daily wage of up to Rs 176 are exempt from paying their own share, but the employer must still deposit its 3.25% contribution for such employees. Contributions are calculated on gross wages actually paid in the month rather than on a notional figure.

Documents required

Before starting the online application, the employer should keep the following ready.

PAN card of the business and of the proprietor, partners or directors.

Certificate of incorporation, partnership deed or registration certificate, as applicable to the constitution.

Registration under the Shops and Establishments Act or the Factories Act.

GST registration certificate.

Address proof of the establishment, such as a utility bill or rent agreement.

Cancelled cheque and bank account details of the entity.

List of employees with their date of joining, wages and Aadhaar numbers.

A Digital Signature Certificate (DSC) of the authorised signatory.

Registration process on the ESIC portal

Employer registration is completed online, either directly on the ESIC portal at esic.gov.in or through the Government of India’s Shram Suvidha portal, which offers a common registration for several labour law enrolments. The broad steps are as follows.

Visit esic.gov.in and select the employer login. Sign up as a new employer using the establishment name, email and mobile number; login credentials are sent to the registered email.

Log in and open the new employer registration form (Form-1), choosing the correct unit type.

Enter the establishment details, nature of business, date of commencement, PAN, address, number of employees and the details of the first set of employees to be covered.

Upload the supporting documents and validate the form using the Digital Signature Certificate.

Where required, pay the advance contribution for the initial period as prompted by the system.

On submission and verification, the system generates the 17-digit ESI registration code, typically within about 7 to 15 working days. A system-generated registration letter (C-11) is issued as proof of registration.

After the establishment is registered, each eligible employee is added on the portal to generate their insurance number and e-Pehchan card, which enables access to ESIC medical benefits.

Ongoing compliance after registration

Registration is only the starting point; the scheme is driven by timely monthly compliance. Employers should note the following recurring obligations.

Deposit the combined employer and employee contribution monthly through the ESIC portal by the 15th of the following month.

File the monthly contribution details on the portal, which now serves the function previously met by periodic returns.

Maintain the two contribution periods, April to September and October to March, and continue contributions for employees who cross the wage ceiling during a period.

Register new joiners who are within the wage ceiling promptly, and update exits and wage changes.

Retain the register of employees, wage records, accident register and attendance records for inspection.

Late payment of contribution attracts simple interest at 12% per annum for the period of delay, along with damages that can be levied on a graded scale depending on the length of default. Failure to register or to remit deducted employee contribution can also lead to prosecution, so it is prudent to align payroll cut-off dates with the 15th-of-the-month deadline. Businesses often manage ESIC alongside their provident fund and ESIC registration obligations so that both social security filings move on the same monthly cycle.

Frequently asked questions

Is ESIC registration mandatory or voluntary?

It is mandatory. Once an establishment employs the notified number of persons and has employees within the wage ceiling, the employer must register within 15 days. There is no option to opt out while the establishment remains coverable.

What is the ESI wage limit for 2026?

Coverage applies to employees earning gross wages up to Rs 21,000 per month, and up to Rs 25,000 per month for employees with disability. Those earning above the applicable limit are not covered.

What are the ESI contribution rates?

The employer contributes 3.25% of gross wages and the employee contributes 0.75%, giving a total of 4%. Employees earning up to Rs 176 as an average daily wage are exempt from their own share.

By when must ESI contributions be paid?

Contributions for a wage month must be deposited by the 15th of the following month through the ESIC portal. Delay attracts interest and damages.

Does an employee stay covered if wages exceed Rs 21,000 mid-period?

Yes. If a covered employee’s wages cross the ceiling during a contribution period, contributions continue until the end of that period (September or March, as applicable), after which coverage may cease.

TAXAJ helps employers assess ESIC applicability, complete registration on the ESIC and Shram Suvidha portals, and run accurate monthly ESIC and EPF contributions as part of end-to-end payroll compliance.
